How long do I have to claim?

We often get asked how long one has to claim.  Well, you have to submit your claim form to the Road Accident Fund, complete with your affidavit, within 3 years generally.  If however your claim is a hit and run where you cannot identify the other vehicle you only have 2 years.  After that there is a certain period in which to issue a summons.

You have longer than 3 years when you suffered from a serious mental incapacity or, and this is more common, you were younger than 18 at the time of the accident in which case your 3 years only begin ticking when you turn 18 (before the Childrens Act came into operation on 1 July 2007, that figure was 21).

Where should a baby's seat be positioned?

This is a safety question, but the Pediatrics journal, said that while there are obstacles to placing a child's seat in the middle, that is the safest position.  Their report indicated children were 43% less likely to be injured that if the seat was placed at the side of the vehicle.  This was to an extent because the child would be better positioned in the event of a side-impact crash.

Is the RAF bankrupt?

Many people read articles about the RAF's alleged technical insolvency.  Firstly, it is alleged - not something that attorneys agree with generally and secondly, technical insolvency is the term - it does not actually have a cash shortage.

The RAF is essentially backed up by the Government so there is no chance of it actually going bankrupt.  There can be no doubt with the increasing death toll on our roads that it will face tough financial times if road safety is not improved - but you should worry about road safety and not whether the Road Accident Fund is allegedly technically insolvent or not!
